IR35 is not new legislation; it has been in place since 2000. Prior to April 2021, contractors were responsible for determining their own IR35 status.

However, since 6 April 2021, this responsibility has shifted to the end client for medium and large organisations.

End clients must now assess whether a role falls inside or outside IR35 and issue a Status Determination Statement (SDS), taking reasonable care in their decision.

IR35 impacts contractors, end clients, and agencies involved in off-payroll working arrangements. It was introduced to address tax avoidance, where individuals working like employees operate through a limited company.

For roles deemed inside IR35, contractors are treated as “deemed employees” for tax purposes, meaning PAYE and National Insurance are applied to their income.

End clients are responsible for determining IR35 status, while the fee-payer (often the agency) is responsible for deducting the appropriate tax.
